We do not collect or retain sensitive (special category) data, and we do not transfer such data to third parties — whether in writing or verbally — nor do we create the conditions under which third parties could access sensitive data in any way.

In exceptional cases, in response to official requests or on the basis of statutory authorization, the Data Controller may be required to provide information, disclose data, transfer data, or make documents available to other authorities. In such cases, the Data Controller shall disclose personal data to the requesting party — provided the requesting party has specified the exact purpose and the scope of data requested — only to the extent strictly necessary for the achievement of the purpose of the request.

Data Subjects' General Rights

a) Right of Access

The data subject has the right to obtain from the Data Controller confirmation as to whether or not personal data concerning them are being processed, and, where that is the case, the right to access such personal data and the information listed in the applicable regulation.

b) Right to Rectification

The data subject has the right to obtain from the Data Controller, without undue delay, the rectification of inaccurate personal data concerning them. Taking into account the purposes of processing, the data subject has the right to have incomplete personal data completed, including by means of providing a supplementary statement.

c) Right to Erasure ('Right to be Forgotten')

The data subject has the right to obtain from the Data Controller the erasure of personal data concerning them without undue delay, and the Data Controller has the obligation to erase personal data without undue delay where certain conditions are met.

d) Right to Restriction of Processing

The data subject has the right to obtain from the Data Controller restriction of processing where one of the following applies:

  1. 1.the accuracy of the personal data is contested by the data subject, for a period enabling the Data Controller to verify the accuracy of the personal data;
  2. 2.the processing is unlawful and the data subject opposes the erasure of the personal data and requests the restriction of their use instead;
  3. 3.the Data Controller no longer needs the personal data for the purposes of the processing, but they are required by the data subject for the establishment, exercise, or defense of legal claims; or
  4. 4.the data subject has objected to processing; in this case, the restriction applies for the period until it is verified whether the Data Controller's legitimate grounds override those of the data subject.

e) Right to Data Portability

In certain cases, the data subject has the right to receive the personal data concerning them, which they have provided to a Data Controller, in a structured, commonly used, and machine-readable format, and has the right to transmit those data to another controller without hindrance from the controller to which the personal data have been provided.

f) Right to Object

The data subject has the right to object, on grounds relating to their particular situation, at any time to processing of personal data concerning them, including profiling based on those provisions.

Where personal data are processed for direct marketing purposes, the data subject has the right to object at any time to processing of personal data concerning them for such marketing, which includes profiling to the extent that it is related to such direct marketing. If the data subject objects to processing for direct marketing purposes, the personal data shall no longer be processed for such purposes.

g) Automated Individual Decision-Making, Including Profiling

The data subject has the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning them or similarly significantly affects them.

This right shall not apply where the decision:

  1. 1.is necessary for entering into, or performance of, a contract between the data subject and the Data Controller;
  2. 2.is authorized by Union or Member State law to which the Data Controller is subject and which also lays down suitable measures to safeguard the data subject's rights and freedoms and legitimate interests; or
  3. 3.is based on the data subject's explicit consent.

Data Controller's Response Period

The Data Controller shall provide information on the action taken on a request under the above provisions to the data subject without undue delay and in any event within one month of receipt of the request. That period may be extended by two further months where necessary. The Data Controller shall inform the data subject of any such extension within one month of receipt of the request, together with the reasons for the delay.

If the Data Controller does not take action on the request of the data subject, the Data Controller shall inform the data subject without delay and at the latest within one month of receipt of the request of the reasons for not taking action and of the possibility of lodging a complaint with a supervisory authority and of seeking a judicial remedy.

Data Protection and Security of Processing

Taking into account the state of the art, the costs of implementation, and the nature, scope, context, and purposes of processing as well as the risk of varying likelihood and severity for the rights and freedoms of natural persons, the Data Controller shall, both at the time of the determination of the means for processing and at the time of the processing itself, implement appropriate technical and organizational measures — such as pseudonymization — which are designed to implement data protection principles, such as data minimization, in an effective manner and to integrate the necessary safeguards into the processing in order to meet the requirements of the applicable regulation and protect the rights of data subjects.

The Data Controller shall implement appropriate technical and organizational measures to ensure that, by default, only personal data which are necessary for each specific purpose of processing are processed. That obligation applies to the amount of personal data collected, the extent of their processing, the period of their storage, and their accessibility. In particular, such measures shall ensure that by default personal data are not made accessible without the individual's intervention to an indefinite number of natural persons.

Notification of the Data Subject in Case of a Personal Data Breach

When a personal data breach is likely to result in a high risk to the rights and freedoms of natural persons, the Data Controller shall communicate the personal data breach to the data subject without undue delay. The communication to the data subject shall describe in clear and plain language the nature of the personal data breach and shall contain the name and contact details of the Data Protection Officer or other contact point where more information can be obtained; the likely consequences of the personal data breach; the measures taken or proposed to be taken by the Data Controller to address the personal data breach, including, where appropriate, measures to mitigate its possible adverse effects.

The data subject shall not be notified as described above where any of the following conditions are met:

  1. 1.the Data Controller has implemented appropriate technical and organizational protection measures, and those measures were applied to the personal data affected by the personal data breach, in particular those that render the personal data unintelligible to any person who is not authorized to access it, such as encryption;
  2. 2.the Data Controller has taken subsequent measures which ensure that the high risk to the rights and freedoms of data subjects referred to above is no longer likely to materialize;
  3. 3.it would involve disproportionate effort. In such a case, there shall instead be a public communication or similar measure whereby the data subjects are informed in an equally effective manner.

Where the Data Controller has not already communicated the personal data breach to the data subject, the supervisory authority, having considered the likelihood of the personal data breach resulting in a high risk, may require it to do so or may decide that any of the conditions referred to above are met.

Reporting a Personal Data Breach to the Supervisory Authority

In the case of a personal data breach, the Data Controller shall, without undue delay and, where feasible, not later than 72 hours after having become aware of it, notify the personal data breach to the supervisory authority competent pursuant to Article 55 of the applicable regulation, unless the personal data breach is unlikely to result in a risk to the rights and freedoms of natural persons. Where the notification is not made within 72 hours, it shall be accompanied by reasons for the delay.
